Danish national individual receives deferred sentence for sharing explicit movie clips on the social platform Reddit

A Danish man has been convicted of uploading nude segments from copyrighted films and television shows on the social media platform Reddit.

According to a law enforcement report obtained by BBC News, the anonymous individual posted 347 clips of explicit scenes in a Reddit group he moderated, which were then watched 4.2 million times.

The country's authorities state he has been given a seven-month suspended sentence for copyright infringement.

Legal analysts say the man was charged under a rarely-used provision in Denmark's intellectual property legislation, with the judge finding that by removing the footage out of their original context, the man had damaged the artists' "ethical entitlements".

He has additionally been found guilty of sharing more than 25 TB of copyrighted data.

From March 2022 to mid-2023, the man known as "the pseudonym KlammereFyr" on Reddit uploaded adult scenes including over 100 female performers.

He distributed them in the forum he was a moderator of.

Per the Denmark's anti-piracy group The Rights Alliance (TRA), his subreddit had more than 6,000 members and participants were encouraged to request clips of specific actors.

In 2023, campaigners reported the case to the authorities on behalf of the affected actors, directors and production companies, which led to the forum being closed down.

One actress, among the actresses whose explicit content were shared in the community, explained to local broadcasters at the time she felt there was a distinction between appearing naked in a film and appearing on Reddit.

The actress stated the uploads constituted "exploitation".

'A significant signal'

The man was arrested in fall 2024 and admitted culpable to the allegations recently.

In a comment following the verdict, the head of the Rights Alliance the organization's leader remarked the decision sent an "significant" signal "that infringements of creators' rights has repercussions".

The ruling is considered unique in the country for its application of the "ethical protections" section of the Danish Copyright Act, which specifies an artist's creation cannot be used in a way which infringes upon their reputation.

Copyright law specialist a legal scholar informed BBC News the legal matter was "unusual" for its focus on the harm to the integrity of an performer, rather than to them financially.

How the case could influence other countries is unclear.

But she said there may be "more and more of such cases" in the future with the growth of artificial intelligence, where "the integrity of an individual's work might be tempered with much more easily".
