Alina Habba has stepped down as the chief federal prosecutor in the state. This follows a court battle that questioned her right to serve.

Attorney General's Statement

Legal Background

The departure follows closely on a federal appellate panel ruled that she had been acting without proper authority as the top prosecutor. This decision is could influence numerous criminal cases in the Garden State.

The court declared that a interim role that did not receive the advice and consent of the Senate violated the Federal Vacancies Reform Act.

Next Steps and Responses

It was also stated that the former prosecutor will stay on at the DOJ as a top consultant. Habba plans to seek further review of the disqualification, with hopes of a different outcome.

In a statement, the Attorney General contended that the judiciary "cannot be permitted to countermand the executive's selection of attorneys entrusted with carrying out the primary duty of the administration of criminal prosecution."
